Pantry to Fork Pty Ltd ("Pantry to Fork") respects the
intellectual property rights of others and expects users of the Pantry to Fork service (the
"Service") to do the same. This policy explains how to report Content you
believe infringes your rights, and how we respond. It forms part of, and should be read
with, our User Agreement.
This policy is intended to be consistent with the notice-and-takedown approach of laws such
as the United States Digital Millennium Copyright Act (DMCA) and the
safe-harbour provisions of the Australian Copyright Act 1968 (Cth), and to be
usable by rights holders anywhere in the world.
1. Reporting infringing content (takedown notice)
If you are a rights holder (or authorised to act for one) and believe Content on the Service
infringes your copyright or other rights, send a written notice to our copyright agent at
contact@pantrytofork.app including all of the following:
- identification of the work or material you say is infringed (for example, a link to or
copy of your original recipe text or photograph);
- identification of the allegedly infringing Content on the Service, with enough detail
for us to find it (for example, the recipe URL);
- your name, postal address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorised by the
rights holder, its agent, or the law;
- a statement that the information in your notice is accurate and, on penalty of perjury,
that you are the rights holder or authorised to act on their behalf; and
- your physical or electronic signature.
Incomplete notices may delay our response. Please do not send invalid or abusive notices.
2. What we do when we receive a valid notice
On receiving a notice that substantially meets the requirements above, we will take
reasonable steps to remove or disable access to the Content, and will make a reasonable
effort to notify the user who posted it, providing a copy of the notice. We may remove
Content that we reasonably consider infringing even before receiving a formal notice.
3. Counter-notice (if your content was removed)
If your Content was removed and you believe this was a mistake or misidentification, you may
send a counter-notice to contact@pantrytofork.app including:
- identification of the Content that was removed and where it appeared;
- your name, postal address, telephone number and email address;
- a statement, under penalty of perjury, that you have a good-faith belief the Content was
removed as a result of mistake or misidentification;
- where permitted, your consent to the jurisdiction of the appropriate courts and to
accept service of process from the complainant; and
- your physical or electronic signature.
Where the law provides for it, we may restore the Content after a waiting period unless the
original complainant notifies us that they have filed legal action.
4. Repeat infringers
We have a repeat-infringer policy. In appropriate circumstances, and at our discretion, we
will disable or terminate the Accounts of users who are the subject of repeated valid
infringement notices, and may withhold any associated Creator payouts.
5. Misuse of this process
Submitting a false or misleading notice or counter-notice may expose you to liability for
damages (including costs and legal fees) under applicable law. If you are unsure whether
material infringes your rights, seek legal advice before sending a notice.
6. A note for global rights holders
Copyright and related rights differ by country. In many places a bare list of ingredients
is not protected, while original written expression, narrative, instructions, images and
compilations generally are. We will act on valid notices regardless of where you are based,
consistent with the laws that apply to us.
